This document sets out the General Conditions of Sale of products on the alover.es website (hereinafter, the "Conditions"), as well as the Contract that binds Promociones Guacana SL (hereinafter, "Alover") and you, as a user of the website (hereinafter, the "User").
The Conditions establish the rights and obligations of the Users and of Alover, as well as the regulation of the purchase process, in accordance with the provisions of the regulations applicable to purchases made by electronic means.
By using this website, Users accept the Terms and Conditions, the Privacy Policy and the Legal Noticepublished on the website. We recommend that you read these documents carefully. Alover may modify the conditions at any time. The conditions applicable to each transaction will be those in force at the time of purchase of the products.

Alover offers the products to end consumers. For the purposes of these Terms and Conditions, an end consumer is understood to be any natural or legal person who purchases products or services for their personal use and enjoyment or as a gift and not to carry out any type of commercial activity with them (hereinafter referred to as "Consumer"). Alover reserves the right not to process orders placed by individuals who do not have the status of Consumer, for the purposes of the Conditions.
The website user will be able to browse the Alover web shop and fill in the shopping bag without having to be registered. Only to complete the purchase it will be essential to provide the mandatory data to access the shipping details of the order.
However, the User may register for access to personal offers and information by providing an e-mail address and a password. Once the registration is completed, the User will receive a confirmation email. The User may change his/her access data from his/her account (email and password).
The user name and password are strictly personal and confidential. The User must maintain the confidentiality of his/her access data. Alover will assume that the uses made using the personal identification codes are made by the registered User, unless the User has previously reported their loss or theft. Alover reserves the right to block access to and use of the website at any time for security reasons.
By registering, the User will be able to access their personal space, in which information relating to their orders, shipments, invoices and purchase preferences will be accumulated. In the personal space, each User may modify their personal data (name, address, telephone number, etc.) in order to facilitate future purchases and notify Alover of any changes to their contact details. In the event of a change of password, the replaced password will be cancelled as a means of identification at the same time as the new one is generated.
Alover products are intended for persons over 18 years of age.
In order to become a registered User, you must be of legal age and have full capacity to contract and subscribe to these Conditions. Registration as a User implies unreserved acceptance of the terms of the Conditions.
In order to provide services, Alover must provide certain personal data of Users to other collaborating companies (carriers, insurers, financial institutions, etc.), which are involved in the process of purchasing and shipping products. In all cases, the data provided are strictly necessary for the specific purpose for which they have been requested.

The User must provide all those data that are essential to complete the purchase process (name, surname, postal address, email address and other contact details). This data must be accurate, truthful, up to date and must allow Alover to contact the User, if necessary. Failure to provide all mandatory information will result in the User's order not being processed.
Alover shall not be liable for any delays or failures in the delivery of the product resulting from any error or total or partial omission of the requested data.
Alover reserves the right to cancel the order and/or inform the relevant authorities if it has reasonable grounds to believe that it is fraudulent.
By accessing the website, the User undertakes to make diligent and appropriate use of the website, and to use it for the specific purposes of the same (product information and its acquisition).
The User must pay for the products as well as the shipping costs, if any, through the means provided for this purpose. Alover will not retain payment data (card numbers, current accounts, etc.) as the payment process will be carried out through secure third-party payment platforms.
Alover may contact Users during the purchase process. This contact will be made by electronic means.
The User who wishes to purchase a product must access the online shop, which contains information on the products, their description, characteristics and prices. Once the product or products have been chosen, the User must add them to the shopping basket, indicating the number of units they wish to purchase. Once the chosen products have been added to the basket, the User will be able to view a summary of their purchase. The User will be able to accept their order by clicking on the option "Finalise Purchase". The User will be provided with the following information:
– Producto
- Number of units
- Price
- Shipping costs
- Taxes and fees (if applicable)
- Discounts
Once the order has been placed correctly, the User will receive an e-mail informing him/her of the purchase of products and that his/her order has been received.
Alover reserves the right not to accept orders that contain incomplete or incorrect information. Alover will not accept orders for products that are out of stock or out of stock. These circumstances will be duly indicated during the purchase process and will not generate any liability either for the User or for Alover. The products offered in the online shop are subject to stock limits. If a product is out of stock, you will be duly informed.
Users shall have the right of withdrawal. The exercise of the right of withdrawal entails the reimbursement of the amount paid for such products, in accordance with Alover's return policy (hereinafter, the "Return Policy").
Product deliveries are made through a courier company. The order will be delivered as soon as possible, and in any case within a maximum period of 48-72 hours for mainland Spain. Once the order leaves our warehouse, you will receive an informative email. This information will also be available in your User account.
In the event that the User has not received their order correctly, or has not received any news about it from the courier or from Alover, seven (7) working days after the purchase of the product, the User must notify Alover.
In the event that it is impossible to deliver the product, the courier company will contact the User in order to arrange a new delivery date, or will leave a notice specifying the possibilities of collection or delivery available to the User.
Once the product has been delivered, the User must check that the product corresponds to what was ordered. If there is any discrepancy between the product ordered and the product received or any defect or flaw in the product, the User must contact Alover within fourteen (14) calendar days of delivery of the product. To do so, the User must specify his/her personal details, the order number, the discrepancy or defect in the product, as well as any other circumstance that he/she considers relevant. Once this communication has been received, Alover will contact the User to resolve the incident as soon as possible.
In the event that the package delivered shows external alterations, knocks or breakage or any other sign of having been tampered with or opened, Alover recommends that the User takes a photograph of the package when it is delivered by the carrier, in order to guarantee a better justification for a later claim, in the event that the products have been damaged or any of them are missing.
The User acquires ownership of the products at the moment he/she receives confirmation of the shipment of the product, as the product leaves Alover's warehouses, or those of third parties contracted by Alover. The ownership of and risk in the products is transferred from Alover to the User when the products leave the warehouse.
The prices on our website are indicated in Euros. The prices indicated on the website do not include taxes, duties or any other customs charges.
In the event that you are resident in the European Union, in accordance with current legislation, the purchase made from our website will be subject to Value Added Tax (VAT).
The shipping costs will be indicated during the purchase process and will be specified before the order is paid for. In the event that the User places the order, he/she accepts the shipping costs.
Alover reserves the right to modify the prices of the products and the shipping costs, as well as any other condition of the purchase process of the products, at any time and without prior notice. The User will always know before starting the purchase process the price of the products and all the details related to the possible costs associated with the purchase.
The means of payment accepted for the purchase of products are as follows:
- Visa and Mastercard through BBVA's Redsys payment gateway.
- PayGold, the User will receive an email or sms with a link to pay by card or Bizum.
In order to protect the security of payments made by credit or debit card, Alover uses secure payment systems. Sensitive payment details are transmitted directly and in encrypted form (SSL) to the financial institution, so under no circumstances will we store data related to cards or payments.
The refund of the price of the products, if applicable, will be made through the same payment method used for the purchase of the corresponding products. Alover complies with the regulations applicable to the different payment mechanisms enabled for the purchase of products.
Alover reserves the right to check personal data relating to the payment of products and, if necessary, to take appropriate measures to prevent fraudulent purchases.
The User has 14 calendar days from the delivery of the product to exercise his/her right of withdrawal. The period for exercising the right of withdrawal shall expire after 14 calendar days from the day on which you or a third party indicated by you acquired material possession of the goods.
In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail). In order to meet the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
In the event of withdrawal, Alover will refund all payments received from you (with the exception of shipping costs) without undue delay. We will proceed to make such refund using the same means of payment used by you for the initial transaction. We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.
The consumer or user shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.
The right of withdrawal shall apply provided that the products are returned in identical conditions to those in which they were sent, together with their packaging, packaging and original seal, complete with accompanying documentation. Alover reserves the right to determine whether the products are in the same condition in which they were sent to you. Products that have been returned damaged, incomplete or used will not be refunded.

In case of return of the product by the User, in exercise of his right of withdrawal, Alover will refund the full amount of the price of the products. Without prejudice to the foregoing, the shipping costs applicable to the return of the product shall be borne by the User.
All the products in our shop are subject to the legally established three-year guarantee periods and in the terms determined by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

Alover will adopt the necessary and reasonable organisational and technical measures in accordance with the state of the art to prevent unauthorised access and to ensure that the entire purchasing process meets the maximum guarantees.
The Conditions shall be governed by Spanish law. For the resolution of any doubt, discrepancy or divergence that may arise in the fulfilment and interpretation of the Conditions and in cases in which the Law does not establish a specific forum, the parties submit to the Courts and Tribunals corresponding to the domicile of the consumer and user.
